Terms and Conditions

1. Definitions and Interpretation

A.    Definitions
(a)    “Application Form” shall mean the application form filled out by you for becoming a member of Schools for India.

(b)    “Cluster Celebrity” shall mean the Celebrity of global recognition who has been signed up by Schools for India to promote the building of schools in that particular Cluster.

(c)    “Cluster Manager” shall mean the person who has been employed by Schools for India to manage the Cluster operations.

(d)    “Member” shall mean a person who has submitted the Application Form with Schools for India and has been registered as a member with us and been issued Membership number.

(e)    “Member-Unit” shall have the meaning assigned to in Section 5A (a) herein.

(f)    “Member-Cluster” shall have the meaning assigned to it in Section 5A (b) herein.

(g)    “Member-State” shall have the meaning assigned to it in Section 5A (c) herein.

(h)    “Membership” shall mean your membership with Schools for India.

(i)    “SCHOOLS FOR INDIA” shall mean Schools for India.

(j)    “Ts & Cs” shall mean the terms and conditions of Membership as set out herein and as amended from time to time.

B.    Interpretation

(a)    the singular includes the plural (and vice versa);

(b)    the headings in these Ts & Cs are inserted for convenience of reference only and are to be ignored in construing and interpreting the terms of Membership;

(c)    reference to the words “include” or “including” shall be construed without limitation;

(d)    reference to a gender shall include references to the female, male and neuter genders;

2.    Membership with Schools for India

A.    SCHOOLS FOR INDIA is proud to welcome you as our Member. Your Membership with SCHOOLS FOR INDIA will be subject to you paying the Membership fees, though it will be effective from the date you forward us your duly completed Application Form. Upon our receiving the Membership fees, you will receive a membership number via email as a confirmation of your status as our Member. You will also be provided with online access to the Schools for India web portal as and when available, for which you will be provided with the user ID and Password. You shall be responsible for maintaining the confidentiality of your password and account. You agree to (a) immediately notify us of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. SCHOOLS FOR INDIA cannot and will not be liable for any loss or damage arising from your failure to comply with this Section 2.

B.    Upon you being confirmed as a Member, you will be entitled to all the benefits and privileges of Membership and liable for all the duties and responsibilities as listed herein.

C.    Your Membership is for your sole and personal use. You may not authorize others to use your login id or your Membership, and you may not assign or otherwise transfer your Membership or login id to any other person or entity, except in accordance with these Ts & Cs.

3.    Acceptance of Terms

Your Membership is subject to the Ts & Cs contained herein, which may be updated by us from time to time without notice to you. You can review the most current version of the Ts & Cs at any time at our website www.schoolsforindia.org. Your Membership is subject to your acceptance of the Ts & Cs as modified from time to time. You agree to abide by the said Ts & Cs by signing the Application Form.

4.    Membership Qualification Criteria:

a)    To become our Member you should be at least 18 years of age. By submitting the Application Form for Membership you certify that you are 18 years old. You may be asked to produce evidence to substantiate your claim during the currency of your Membership with us.

b)    You agree to provide true, accurate and complete information about yourself in the Application Form. You agree to maintain and promptly notify us of any change in the data as reflected in your Application Form to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or if SCHOOLS FOR INDIA has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, we have the right to suspend or terminate your Membership with us and refuse any and all current or future use of the benefits and privileges offered to our Members.

c)    SCHOOLS FOR INDIA shall use or disclose all such information provided by you in your Application Form only for the purposes for which such information was collected, or as required by law.

d)    By becoming our Member you represent that you have the ability to monitor a project on a scientific basis, though such project could be in any field, type or area.

e)    You further represent that you have become a Member because of your long-term commitment to help the underprivileged children in India and elsewhere and have the heart and mind to help them obtain their education regardless of race, religion, caste or creed, and that your Membership with us is not driven by any political or religious motives.

5.    Your Role as a Member

A.    SCHOOLS FOR INDIA has three types of Members namely Member Unit, Member Cluster and Member-State.

(a)    A Member-Unit is a Member who will be associated with the development and progress and entitled to receive information pertaining to a specific school to be set up by SCHOOLS FOR INDIA (“Unit”). As a Member-Unit you will have the role of monitoring the building of a specific Unit and will posses authorized access to monitor the said Unit from the time of its conception, through building of the Unit and running of the Unit after it is successfully constructed.

(b)    A Member-Cluster is a Member who will be associated with the development and progress and entitled to receive information pertaining to all the schools to be set up by SCHOOLS FOR INDIA in a specific district (“Cluster”). As a Member-Cluster you will have the role of monitoring the building of all Units in a specific Cluster and will posses authorized access to monitor each of the said Units in the Cluster from the time of its conception, through building of the said Units and running of the said Units after they are successfully constructed.

(c)    A Member-State is a Member, who is elected from amongst the Member-Clusters associated with a specific Cluster by the Member-Clusters and Member-Units associated with that Cluster to act as the head Member of that Cluster. Each Member-State will have the role of actively overseeing building of all Units in a specific Cluster and will posses authorized access to monitor each of the said Units in the Cluster from the time of its conception, through building of the said Units and running of the said Units after they are successfully constructed. The Member-States of the various Clusters will be the representative of the Member-Units and Member-Clusters associated with their specific Cluster and work closely with the Trustees and other staff of SCHOOLS FOR INDIA in conceptualizing, building and running as the case may be, of the Units in the specific Cluster to which they are associated. A Member-State is to hold such post for a period of one year, and no Member is eligible for re-appointment as a Member-State whether for the said Cluster or for any other Clusters. No person can act as the Member-State for more than one Cluster. In the event, the post of a Member-State becomes vacant due to resignation, removal, death, incapacity or any other reason, the Member-Clusters and Member-Units of that particular Cluster shall re-elect a Member-State who shall hold such post till the end of the year, and if such person has served as Member-State for less than 6 months, then he/she may be eligible for re-appointment for the next year as well.

B.    It is expressly stated that the election process for electing the Member-States for each Cluster is conducted solely by the Member-Clusters and Member-Units of the said Cluster and SCHOOLS FOR INDIA will not be a party to such election process and will not in any manner be held liable for any claims, damages, etc. arising in this regard.

6.    Your Responsibilities and Opportunities as a Member-

A.    Your core responsibilities as a Member, whether you are a Member-Unit, Member-Cluster or Member-State are as follows:

  • To provide lasting moral support for the Unit(s) with which you are associated.
  • To ensure that the planning, building and running of the Unit(s) with which you are associated takes place in keeping with the objects for which SCHOOLS FOR INDIA was established. In order to view our objects please visit our website, www.schoolsforindia.org
  • To provide all assistance and required inputs to SCHOOLS FOR INDIA to enable uniformity in quality of construction of the Units as well as in the education imparted in the Units and to ensure that costs in connection with planning, building and running of the Units is minimized.
  • To participate in all the crucial meetings, which will be conducted to decide the sites, building specifications for the Unit(s), and other related matters from time to time. The meeting schedule will be published in the website and also the members would be intimated through e-mail.
  • To assist SCHOOLS FOR INDIA to overcome all hurdles for initiating and running the Unit(s), by providing actual and moral support to us.
  • To participate in the site visits as and when necessary to ensure that the various agencies engaged by SCHOOLS FOR INDIA is performing their duties and tasks as per our stated objectives.
  • To help in identifying the required volunteers time to time for completing the necessary tasks in connection with the conception, building or running of the Unit(s) as and when needed.
  • Any other responsibility or duty which you voluntarily take on in your role as a Member whether as a result of your interactions with other Members / Trustees / employees of SCHOOLS FOR INDIA or otherwise.

B.    All the above-mentioned responsibilities are done on mutual faith basis and the members are not expected to incur any costs in connection with the conceptualization, building and running the Unit(s) excepting for their own voluntary time. However, all expenses incurred by a Member in connection with providing assistance to SCHOOLS FOR INDIA, attending meetings, participating in site visits etc. will be solely at the cost of the Member.

7.    Your Privileges as a Member

As a Member of SCHOOLS FOR INDIA you will be entitled to the following privileges:

  • Online access to information relating to a specific Unit / Cluster as the case may be.
  • To get the SCHOOLS FOR INDIA monthly newsletter by email.
  • Access to the Cluster Celebrity, through e-mail and meeting him/her for the annual meeting. A Cluster Celebrity is very well known celebrity from any of the field and the one who volunteers to support a particular cluster. The cluster celebrity would be a person from anywhere in the world but would like to volunteer for development of the education for underprivileged children in the world and India in particular. The celebrity would be actively taking part in each of the school project for a particular cluster and also work with the members.
  • Access to the Unit(s) sites with prior permission from the Cluster Manager, the SCHOOLS FOR INDIA support staff at each location.

8.    Member Conduct

A.    You agree to use your Membership login id solely for the purpose of communicating with SCHOOLS FOR INDIA, our staff/Trustees or with fellow Members and solely in order to/in connection with the achievement of the objectives of SCHOOLS FOR INDIA. You specially agree that you will not communicate with or harass the Cluster-Celebrity or any of your fellow Members for any purpose other than for the planning, building or running of the Unit(s) with which you are associated.

B.    You agree to use your Membership with SCHOOLS FOR INDIA in a manner consistent with any and all applicable laws and regulations.

C.    You agree not to upload, post, email or otherwise transmit any content / material that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable to anyone using your SCHOOLS FOR INDIA login id or in your capacity as our Member.
D.    You agree not to impersonate any person or entity, including, but not limited to, a SCHOOLS FOR INDIA Member, Trustee or staff, or falsely state or otherwise misrepresent your Membership with a person or entity.

E.    You agree not to upload, post, email or otherwise transmit any content/material that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed under nondisclosure agreements or otherwise) using your SCHOOLS FOR INDIA login id or in your capacity as our Member.

F.    You agree not to upload, post, email or otherwise transmit any content/material that infringes any patent, trademark, trade secret, copyright or other proprietary rights of SCHOOLS FOR INDIA or any other party using your SCHOOLS FOR INDIA login id or in your capacity as our Member including but not limited to designs and plans of any Units which you are privy to, name or detail of any anonymous donor to SCHOOLS FOR INDIA, name or detail of any Cluster Celebrity, etc.

G.    You agree not to upload, post, email or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation or transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment using your SCHOOLS FOR INDIA login id.

9.    Fees and Payments

A.    The following amount shall be payable by you towards Membership fees:

Member-Cluster
Annual-    Rs.   18,000/-
Ten Years- Rs. 1,80,000/-
Life-    Rs  2,70,000/-

Member-Unit

Annual-    Rs.  3000/-
Ten Years-   Rs.30,000/-
Life-      Rs.45,000/-

B.    The above fees is payable upon submission of your Application Form for Membership and your Membership with us is conditional upon our receipt of the said fees. In the case of an annual or ten year Membership, your Membership will automatically expire upon expiry of the said annual or ten-year period as the case may be. Should you wish to renew your Membership with us for further periods, you must communicate the same to SCHOOLS FOR INDIA by paying the relevant Membership prior to expiry of your current Membership term.

C.    Annual Memberships are non-transferable. Ten year and Life Memberships are transferable to your nominee, (who could be your son, daughter, spouse, brother or sister) as indicated by you in your Application Form provided that any such nominee who is to replace you as our Member shall immediately notify SCHOOLS FOR INDIA upon such replacement.

10.    Indemnity

You will defend, indemnify, and hold harmless SCHOOLS FOR INDIA, its Trustees, officers, employees and agents for any losses, costs, liabilities and expenses (including reasonable attorneys’ fees) relating to or arising out of your Membership, including any breach by you of the terms of this Ts & Cs.

11.    Termination

A.    You agree that SCHOOLS FOR INDIA in its sole discretion, may terminate your password, account (or any part thereof) or right to access/receive any information / newsletter for if SCHOOLS FOR INDIA believes that you have violated or acted inconsistently with the letter or spirit of the Ts & Cs or with the objectives of our organisation. You agree that any such termination of your access to information / right to receive newsletters under any provision of this Ts & Cs may be effected without prior notice, and acknowledge and agree that SCHOOLS FOR INDIA may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or any information. Further, you agree that SCHOOLS FOR INDIA shall not be liable to you or any third-party for any such termination of your access to information / right to receive newsletters.

B.    You may terminate your Membership with us by providing us a notice of two weeks. However, you will not be entitled to a refund of the Membership fees paid by you or any portion thereof.

C.    Your Membership will automatically terminate if you have not renewed the same in accordance with Section 9B above.

12.    Intellectual Property and Proprietary rights

A.    The plans and designs of the Units to be constructed by SCHOOLS FOR INDIA and the unique teaching style and method of education to be imparted therein, are the intellectual property belonging to SCHOOLS FOR INDIA and are of a confidential nature. You agree not to use, copy, reproduce, distribute, disclose, publish, or disseminate any such plan, design or teaching style that you have access to in your capacity as a Member to any third party except in order to carry out your duties and responsibilities as a Member of SCHOOLS FOR INDIA and solely for the purpose of achieving SCHOOLS FOR INDIA’s objectives. You shall have no claim to having been granted any other right in such intellectual property or confidential information of SCHOOLS FOR INDIA, now or in the future. Nothing herein shall be construed as imposing an obligation on SCHOOLS FOR INDIA to disclose to you in your capacity as a Member, now or in the future, any such confidential information whether pertaining to its plans, designs, and teaching style or otherwise.

B.    The images, logos, names and representations on the SCHOOLS FOR INDIA website or appearing on any of our newsletters or other document issued by us ,which identify SCHOOLS FOR INDIA or any member of SCHOOLS FOR INDIA are proprietary marks of SCHOOLS FOR INDIA or such other member and rights to the same are reserved.

C.    The copyright in the content contained in the SCHOOLS FOR INDIA website or in any of our newsletters or other document issued by us belongs to SCHOOLS FOR INDIA or its licensed source. The said content may not be used for commercial purposes. The content is protected by copyright and may not be reproduced or appropriated in any manner without the written permission of SCHOOLS FOR INDIA.

D.    In addition, other Members may post copyrighted information, which has copyright protection whether or not it is identified as copyrighted. Except for that information which is in the public domain or for which you have been given permission, you will not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information.

13.     Disclaimer of Warranties

A.    All information is provided without guarantees or warranties of any kind whether express or implied. SCHOOLS FOR INDIA does not represent that the information contained in its newsletters or otherwise provided to its Members is accurate, comprehensive, verified, complete or error free. Furthermore any ideas and/or information provided would not necessarily reflect the views of SCHOOLS FOR INDIA or its Trustees or employees. SCHOOLS FOR INDIA assumes no responsibility for and shall not be liable in any way for any error or omission in any newsletter or information provided to you or for any delayed timelines or mis-delivery of any such information or newsletter, though SCHOOLS FOR INDIA will endeavor to provide such information correctly and in a timely and efficient manner.

B.    Opinions, advice, statements, offers, or other information or content made available as a result of, or in connection with your Membership, but not directly by SCHOOLS FOR INDIA, are those of their respective authors, and should not necessarily be relied upon. Such authors are solely responsible for such content/information. Under no circumstances will SCHOOLS FOR INDIA and or its Trustees, agents, employees be responsible for any loss or damage resulting from anyone’s reliance on information or other content transmitted to Members.

14.     Limitation of liability

A.    You are solely responsible for your interactions with other Members. SCHOOLS FOR INDIA reserves the right, but has no obligation, to monitor and/or mediate disputes between you and other Members.

B.    SCHOOLS FOR INDIA does not screen the persons registering for Membership in any way. As a result, SCHOOLS FOR INDIA will not be liable for any damages, direct, indirect, incidental and/or consequential, arising out of the Membership, including, without limitation, damages arising out of communicating and/or meeting with other Members introduced to you via your Membership such damages including, without limitation, physical damages, bodily injury and or emotional distress and discomfort.

15.    General Information

A.    The Ts & Cs constitute the entire agreement between you and SCHOOLS FOR INDIA and govern your Membership with us, superseding any prior agreements between you and SCHOOLS FOR INDIA.

B.    The failure of SCHOOLS FOR INDIA to exercise or enforce any right or provision of the Ts & Cs shall not constitute a waiver of such right or provision. If any provision of the Ts & Cs is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Ts & Cs shall remain in full force and effect.

C.    Please report any violations of the Ts & Cs to us at members@schoolsforindia.org

D.    This Ts & Cs and your Membership is governed by the laws of India. You hereby irrevocably consent to the exclusive jurisdiction and venue of courts in Chennai, Tamil Nadu, India in all disputes arising out of or relating to the Ts & Cs or in connection with your Membership.

E.    This Ts & Cs is binding upon the agents, successors, assigns, and servants of both SCHOOLS FOR INDIA and you.
